These terms apply when you create an account or use Sendza ("we", "us", "the service"). By creating an account you agree to them. If you don't agree, don't use the service.
1. The service
Sendza lets you send bulk SMS to US phone numbers from a web dashboard. You upload numbers, write message templates and start sending. Messages are delivered through third-party SMS providers and mobile carriers that we don't control.
There is no API. The service is used only through the dashboard.
2. Your account
- You must be at least 18 years old and legally able to agree to these terms.
- You sign up with a username, an email address and a password. Keep your password safe, and keep your email up to date: it's how you reset a forgotten password.
- You're responsible for everything done with your account.
- One person or business may hold more than one account, but you may not create accounts to get around a suspension.
3. Acceptable use
You may only send messages that are lawful and that recipients agreed to receive. You must not use the service to send:
- spam, or messages to numbers that didn't consent, including bought, rented or scraped lists;
- phishing, scams, fake prizes, fake account or delivery alerts, or links that pretend to be another company;
- malware, or links to it;
- harassment, threats, hate speech, or sexual content;
- content that promotes illegal goods or services;
- anything that breaks a law, including the US Telephone Consumer Protection Act (TCPA), or carrier rules.
Marketing messages must identify your business and include a way to opt out, such as "Reply STOP to opt out". You must stop texting anyone who opts out.
You confirm that you have the right to use every phone number you upload.
4. Balance and payment
- The service is prepaid. You add balance by sending USDT on one of the networks shown in your dashboard. 1 USDT is credited as $1 of balance.
- The minimum top-up is shown on the Add funds page. Balance is credited after we check the transfer on the blockchain.
- You must send the exact coin (USDT) on the exact network shown. Transfers of other coins, on other networks, or to the wrong address can't be credited or recovered.
- Each number you send to costs one SMS at your current price per SMS. A list is charged when we start sending it, and only if your balance covers it in full. Every number we send is charged, including numbers a carrier doesn't deliver. If we can't send a list at all, its charge is returned to your balance.
- Prices are listed on the Pricing page and in your dashboard. We may change prices for the future; a list is charged at the price on your account when we start sending it, and we'll never change the price of messages that have already been sent.
- Your balance doesn't expire.
- Referral bonuses, when offered, are paid as balance once per invited customer, on their first credited top-up. We may cancel bonuses earned with fake or duplicate accounts.
5. No refunds
Balance can only be used to send SMS through the service. It can't be refunded, withdrawn, exchanged for crypto or cash, or transferred to another account. This applies when you stop using the service and when your account is closed, unless the law that applies to you requires otherwise.
6. Delivery
Our team sends your lists through SMS providers and mobile carriers. We don't guarantee that any message reaches a phone, or when: carriers can filter or block messages, and phones can be off or out of range. "Delivered" in your dashboard means we have sent the messages out; it is not a delivery receipt from the carrier.
7. Suspension and closure
We may pause sending, suspend or close an account, without notice, if we reasonably believe it breaks these terms, puts the service or our SMS providers at risk, or is used for fraud. Remaining balance on an account closed for breaking section 3 is forfeited.
You can stop using the service at any time. To have your account deleted, contact our support team. Payment records are kept even after an account is deleted; see our privacy policy.
8. Disclaimers
The service is provided "as is" and "as available". We don't promise that it will be uninterrupted, error-free or suitable for a particular purpose.
9. Limitation of liability
To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost profits, lost business or lost data. Our total liability to you for any claim is limited to the amount you paid us in the 3 months before the claim.
10. Your responsibility to us
If someone makes a claim against us because of messages you sent or because you broke these terms, you agree to cover the costs, damages and legal fees that result.
11. Changes to these terms
We may update these terms. The date at the top shows the latest version. If you keep using the service after a change, the new terms apply.
